Purpose of These Terms
These General Terms of Use (the “Terms”) are intended to define the rules governing access to and use of the GENIEGOOD mobile application as well as the associated digital services, operated by GENIEGOOD SOLUTIONS SAS (“GENIEGOOD”, “we”, “us”, “our”).
By downloading, accessing, or using the application, you fully and unreservedly accept these Terms. If you do not accept these Terms, you must refrain from using the application.
GENIEGOOD reserves the right to modify or update these Terms at any time. Continued use of the application after the publication of modifications constitutes acceptance of the updated Terms.
Description of the Platform
GENIEGOOD is a technology platform designed to facilitate connections between:
individuals seeking services (“Users”);
independent professionals or entities offering services or assignments (“Partners” and “Mission Providers”).
GENIEGOOD does not directly provide the services offered via the platform and does not act as a service provider.
Definitions
For the purposes of these Terms:
User: means any person using the application to request or access services.
Partner: means any natural or legal person registered on the platform in order to offer services.
Mission Provider: means any person or entity carrying out missions or tasks offered via the application.
Application: means the GENIEGOOD mobile application and the associated services.
Eligibility Conditions and Account Creation
Access to the application is reserved for individuals aged at least eighteen (18) years or otherwise legally authorized to use this type of service.
All users agree to provide accurate, complete, and up-to-date information when creating their account.
Login credentials are strictly personal and must be kept confidential. Any activity carried out through an account is deemed to have been performed by the holder of that account.
GENIEGOOD reserves the right to suspend or restrict access to any account in the event of inaccurate information, misuse, or violation of these Terms.
Rules of Use
Users, partners, and mission providers agree to:
use the application in compliance with applicable laws and regulations;
refrain from any illegal, fraudulent, abusive, or misleading activity;
not interfere with the proper functioning or security of the platform;
respect the rights and obligations of other users of the platform.
Any violation of these rules may result in temporary suspension or permanent termination of access to the application.
Obligations of Partners and Mission Providers
Partners and mission providers expressly acknowledge that:
they operate independently and under their sole responsibility;
they are solely responsible for the quality, legality, and execution of their services or missions;
they undertake to comply with all applicable professional, legal, tax, and regulatory obligations;
they must hold all required authorizations, licenses, and insurance necessary for the performance of their activity.
GENIEGOOD exercises no control, supervision, or guarantee over the services provided by partners or mission providers.
Financial Terms and Payments
Certain services offered via the application may be subject to fees.
Payments are processed by secure third-party payment service providers.
GENIEGOOD does not collect, store, or have access to users’ bank details or payment information.
Applicable prices, fees, and charges are displayed in the application where relevant.
Partners and mission providers remain solely responsible for their tax, social, and financial obligations.
Cancellations, Modifications, and Refunds
Cancellation and refund conditions vary depending on the nature of the service or mission concerned.
Fees may apply in the event of late cancellation or modification.
Any claim or request must be submitted as soon as possible via the application or the dedicated support channels.
GENIEGOOD reserves the right to review refund requests in accordance with the applicable conditions.
Liability and Limitation
GENIEGOOD acts exclusively as an intermediary platform and shall not be held liable for:
the performance, quality, or results of services provided by partners or mission providers;
disputes, damages, losses, or incidents occurring between users and third parties;
any indirect or consequential damages related to the use of the application.
Any interaction or contractual relationship between users, partners, and mission providers is entered into under their sole responsibility.
Personal Data
The collection and processing of personal data are governed by the GENIEGOOD Privacy Policy, which forms an integral part of these Terms. Users acknowledge that they have read and understood it.
Prohibited Activities
It is strictly prohibited to:
use the application for illegal or misleading purposes;
publish or transmit any unlawful, harmful, or inappropriate content;
attempt to manipulate, defraud, or compromise the platform or its users.
GENIEGOOD reserves the right to take any appropriate legal or technical measures in the event of a violation.
Suspension and Termination
Users may delete their account at any time via the application.
GENIEGOOD may suspend or permanently terminate access to the application in the event of a violation of these Terms, without prior notice.
Any outstanding financial obligations must be settled before the final closure of the account.
Governing Law and Jurisdiction
These Terms are governed by the laws of the Kingdom of Morocco. Any dispute relating to their interpretation or execution shall fall under the exclusive jurisdiction of the competent Moroccan courts.
