GENERAL CONDITIONS OF SALE (CGV)

1. Purpose

These General Conditions of Sale (“CGV”) govern all paid transactions carried out through the GENIEGOOD mobile application and related digital services operated by GENIEGOOD SOLUTIONS SAS (“GENIEGOOD”, “we”, “us”, or “our”).

They define the conditions under which Users purchase services made available on the platform and the financial terms applicable to such transactions.

By placing an order or making a payment through the application, the User expressly accepts these CGV without reservation.

2. Platform Role and Nature of Services

GENIEGOOD operates a digital intermediary platform that facilitates connections between:

  • Users requesting services or missions; and

  • Independent partners or mission providers offering such services.

GENIEGOOD does not directly perform the services offered on the platform unless explicitly stated.
Partners and mission providers act independently and under their own responsibility.

GENIEGOOD acts solely as a technical and financial intermediary.

3. Service Offers and Availability

Services displayed on the application are provided by independent partners or mission providers.

Each service listing may include:

  • Description of the mission or service

  • Pricing information

  • Estimated execution conditions

  • Any applicable additional fees

Availability of services may vary depending on location, partner availability, and operational constraints.

4. Order Process and Contract Formation

The order process follows these steps:

  1. The User selects a service through the application.

  2. The User reviews the price and service details.

  3. The User confirms the request and proceeds to payment.

  4. The order becomes binding upon payment confirmation.

The contractual relationship for service execution is formed between the User and the Partner/Mission Provider, while GENIEGOOD remains the intermediary platform.

5. Pricing and Fees

All prices displayed on the application are expressed in the applicable currency and include any platform service fees where indicated.

GENIEGOOD reserves the right to:

  • Modify pricing at any time;

  • Apply service fees, commissions, or platform charges where applicable.

The total payable amount is clearly displayed before payment validation.

Partners and mission providers are solely responsible for their own taxes, social charges, and fiscal obligations.

6. Payment Terms

Payments for services are collected through secure third-party payment service providers integrated into the GENIEGOOD platform.

By making a payment, the User authorizes GENIEGOOD to:

  • Collect funds on behalf of the Partner or Mission Provider;

  • Deduct any applicable platform fees or commissions as would be clearly displayed ahead of payment.

  • Transfer the remaining amount to the Partner or Mission Provider after service validation or according to internal payout schedules.

GENIEGOOD does not store or have direct access to users’ banking or card details.

Accepted payment methods are displayed within the application.

6A. Top-Up System

GENIEGOOD may provide a prepaid credit system (“Credits”) allowing Users to top up their account balance and use such Credits to pay for services available on the platform.

Credits:

  • Are prepaid amounts voluntarily added by the User;

  • Can be used exclusively within the GENIEGOOD platform;

  • Do not constitute a bank account, electronic money, or deposit service;

  • Are non-transferable and cannot be resold or exchanged outside the platform.

Top-ups are processed through secure third-party payment providers and are considered final once confirmed.

Unless required by applicable law or in exceptional circumstances (such as technical error or unauthorized transaction), purchased Credits are non-refundable.

GENIEGOOD reserves the right to:

  • Set minimum or maximum top-up amounts;

  • Suspend or block the use of Credits in case of suspected fraud, abuse, or regulatory requirements;

  • Expire promotional or bonus Credits under conditions specified within the application.

In the event of account suspension, termination, or fraud investigation, GENIEGOOD may temporarily freeze the User’s Credit balance until the situation is resolved.

7. Partner Payouts

GENIEGOOD processes payouts to partners and mission providers after:

  • Confirmation of service completion; or

  • Expiration of any dispute or review period; or

  • Any other operational validation process defined by the platform.

GENIEGOOD reserves the right to temporarily hold funds in cases of suspected fraud, disputes, or regulatory requirements.

8. Cancellations and Modifications

Cancellation conditions may vary depending on the nature of the service requested.

Unless otherwise specified within the service details:

  • Early cancellations may be eligible for full or partial refunds;

  • Late cancellations may incur cancellation fees;

  • No-shows may result in non-refundable charges.

Any modification or cancellation request must be submitted through the platform or official support channels.

9. Refund Policy

Refund requests are assessed on a case-by-case basis, taking into account:

  • Service status (completed, ongoing, or not started)

  • Cancellation timing

  • Reported issues or disputes

Refunds, when approved, are issued through the original payment method within a reasonable processing period.

GENIEGOOD reserves the right to refuse abusive or fraudulent refund claims.

10. Disputes and Chargebacks

Users agree to contact GENIEGOOD support before initiating any chargeback or payment dispute with their financial institution.

In the event of a dispute:

  • GENIEGOOD may temporarily suspend the transaction;

  • Investigate the claim;

  • Request supporting documentation from the User and the Partner.

Abusive chargebacks or fraudulent claims may result in account suspension or permanent termination.

11. Liability Related to Transactions

GENIEGOOD acts as an intermediary platform and shall not be held liable for:

  • The quality, legality, or execution of services performed by Partners;

  • Delays, cancellations, or disputes arising from service delivery;

  • Indirect or consequential damages linked to transactions.

Partners and mission providers remain fully responsible for the services they offer and execute.

12. Right of Withdrawal

Given the on-demand and personalized nature of services provided through the platform, the right of withdrawal may not apply once the service execution has begun, in accordance with applicable consumer protection laws.

Users acknowledge and accept this limitation at the time of order confirmation.

13. Fraud Prevention and Security

GENIEGOOD reserves the right to:

  • Verify transactions;

  • Request identity verification;

  • Suspend or cancel any transaction suspected of fraud, abuse, or unauthorized activity.

14. Governing Law and Jurisdiction

These General Conditions of Sale are governed by the laws of the Kingdom of Morocco.

Any dispute relating to payment, transactions, or interpretation of these CGV shall fall under the jurisdiction of the competent courts of Morocco.
